Emotional Courtroom Moment as Victim Confronts Man Convicted in Random Subway Assault

NEW YORK — An award-winning artist who was permanently paralyzed after being shoved into a moving subway train in Manhattan delivered an emotional victim impact statement Wednesday as the man convicted in the brutal attack was sentenced to 20 years in prison.

Emine Ozsoy, a 38-year-old Turkish-born artist, addressed the court from a motorized wheelchair during sentencing proceedings in Manhattan Supreme Court, describing how the violent and random assault changed every aspect of her life.

Ozsoy, now paralyzed from the shoulders down, tearfully recounted the devastating physical, emotional, and financial consequences she continues to endure after the 2023 attack.

“I am in this condition because of this evil action,” Ozsoy told the court.

“I have a long life ahead of me, yet I have to live with these circumstances,” she added as her mother comforted her during the emotional hearing.

Attacker Convicted on Attempted Murder Charges

The defendant, 42-year-old Kamal Semrade, was sentenced after a jury convicted him earlier this year on charges including attempted murder and assault.

Prosecutors said Semrade attacked Ozsoy without warning at the Lexington Avenue and East 63rd Street subway station in May 2023.

According to investigators, both individuals had boarded the same subway train earlier that morning after entering at the Roosevelt Avenue station in Queens.

Authorities said the two were complete strangers and had never interacted before the incident.

When they exited the train in Manhattan, prosecutors said Semrade suddenly walked behind Ozsoy and violently shoved her toward the side of a moving subway car.

The impact caused Ozsoy’s head and face to slam into the train before she was thrown back onto the platform.

Victim Suffered Life-Changing Injuries

Following the attack, Ozsoy was rushed for emergency medical treatment and later underwent spinal surgery.

Doctors ultimately determined that she had suffered catastrophic spinal injuries that left her permanently quadriplegic.

Since the assault, Ozsoy has required constant assistance for daily activities and basic personal care.

During her statement in court, she described the painful reality of living with permanent paralysis.

“Each day brings new challenges,” Ozsoy said. “I am unable to meet even my most basic needs independently and must constantly rely on the help of others.”

The attack also ended her ability to continue her work as a professional artist.

Ozsoy’s creative work had previously been featured in publications including Chicago Magazine and NPR, according to court statements.

She explained that beyond the emotional and physical suffering, the injuries have also created severe financial hardships because she can no longer work independently.

Judge Criticizes Lack of Remorse

During sentencing, Semrade’s defense attorney requested leniency, citing the defendant’s longstanding mental health struggles.

However, the judge sharply criticized Semrade’s behavior in court, particularly his refusal to apologize to the victim.

When given an opportunity to address Ozsoy directly, Semrade reportedly declined and avoided looking at her.

Manhattan Supreme Court Judge Althea Drysdale called the random nature of the attack “profoundly disturbing” and noted the complete absence of remorse shown by the defendant.

“I’ve waited to see you express even a scintilla of remorse,” the judge said. “None has been forthcoming.”

Prosecutors Describe Attack as Completely Random

Assistant District Attorney Katelyn Damanis emphasized during proceedings that Ozsoy was targeted without any prior connection to the defendant.

“The victim was a complete stranger to the defendant,” Damanis said in court. “She had never met him, never spoken to him, never interacted with him.”

After the assault, prosecutors said Semrade fled the subway station and returned to a shelter in Queens.

Authorities later identified him with assistance from shelter employees who recognized him from surveillance images shared through an NYPD CrimeStoppers alert.

He was arrested two days after the attack.

Manhattan DA Calls Injuries “Catastrophic”

Following the sentencing, Manhattan District Attorney Alvin Bragg released a statement describing the life-altering consequences of the assault.

Bragg said Semrade’s actions caused “catastrophic, permanent injuries” that completely uprooted Ozsoy’s life.

“After the attack, the defendant fled, leaving the victim helpless on the platform,” Bragg stated.

While acknowledging that no sentence could undo the damage caused, prosecutors said they hope the prison term provides some measure of justice as Ozsoy continues her long recovery journey.

The case once again highlights growing concerns surrounding random acts of violence within New York City’s subway system and the lasting trauma experienced by victims of public transit attacks.
